A Power of Attorney (PoA) is an instrument of agency that allows an NRI to delegate their legal authority to an appointee in India. This is an essential tool for managing property transactions, banking operations, and litigation without the necessity of international travel.

Taxonomy of Powers: General vs. Special

  • General Power of Attorney (GPA): Grants broad powers to the agent, including the right to buy/sell any property and manage all bank accounts. **Warning**: GPA is rarely accepted for property sales in modern Indian law due to past misuse.
  • Special Power of Attorney (SPA): Restricted to a specific task (e.g., 'Executing the sale deed of Flat X on June 15th'). This is the preferred legal instrument for NRIs as it minimizes the risk of fraudulent activity.

The Execution Workflow for NRIs

  1. Drafting: The document should be drafted on plain paper (not stamp paper) by a legal professional in India, tailored to the specific local sub-registrar requirements.
  2. Notarization: The NRI must sign the document in the presence of a Notary Public in their host country.
  3. Consular Attestation or Apostille:
    • For Hague Convention countries (UK, USA, Australia), the document must be **Apostilled** by the local Ministry/Secretary of State.
    • For other countries, it must be attested by the local **Indian Consulate**.
  4. Adjudication in India: This is the most crucial steps. Within 3 months of the PoA reaching India, it must be presented to the District Registrar for 'Adjudication', where the appropriate Indian stamp duty is paid and the document is registered.

Always include a 'Revocation Clause' in your PoA. This ensures that you can cancel the authority provided to the agent at any time through a formal legal notice.
